Welcome, and thank you for your interest in Theta Integrated. The website located at https://theta-integrated.com/ (the "Site") is owned and operated by [Theta Integrated, LLC], (the "Company," "we," "our," or "us"). These Terms and Conditions (the "Terms") govern your access to and use of the Site, and your application to, purchase of, and participation in any program, event, or service we offer, including The ADVANCE retreat (collectively, the "Services"). Visitors to the Site and users of the Services are referred to in these Terms as "you," "User," or "Participant."

By accessing the Site, submitting an application, making a payment, or participating in any of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms presented to you in connection with a specific Service (including any participant agreement, medical intake form, waiver, or release you sign). If you do not agree to these Terms, please do not use the Site or the Services.

PLEASE READ CAREFULLY, AND NOTE THE MANDATORY ARBITRATION PROVISION AND WAIVER OF CLASS ACTION PROVISION IN SECTIONS 16 AND 17.

Communications Consent

By submitting a form, application, or scheduling request through the Site, you give us express consent to contact you by phone (mobile or landline), email, or text message regarding your application, enrollment, consult and foundations calls, payments, event logistics, and your account. Message and data rates may apply. Message frequency varies. You may opt out of text messages at any time by replying "STOP," and you may unsubscribe from marketing emails using the link in any email. Opting out of marketing messages will not stop transactional messages that are necessary to deliver a Service you have purchased.

1. The ADVANCE

The ADVANCE is a four-day, in-person experience for women, currently scheduled for January 8–11, 2027, held at [venue name and location] (the "Event"). The Event is facilitated by Melanie Winsor and a team of facilitators trained in the Theta Method. Unless otherwise stated in writing, your Event registration includes programming, accommodations, meals, and the additional inclusions described on the Event page at the time of purchase. Travel to and from the Event location is not included and is your sole responsibility.

The inclusions, schedule, facilitators, and specific activities described on the Site are provided in good faith and are subject to reasonable change. We may substitute facilitators, adjust the schedule, or modify activities when we believe doing so serves the group or is necessary due to circumstances outside our control. Such changes do not entitle you to a refund except as provided in Section 3.

2. Application, Acceptance, and Enrollment

Participation in The ADVANCE is by application only. Submitting an application or scheduling an optional pre-application call does not guarantee acceptance. We review applications at our sole discretion and may decline any applicant for any lawful reason, including our assessment of fit for the group.

Enrollment is complete once you have been accepted and your payment (or first installment) has been received. Following enrollment, each Participant is required to complete a medical review and consult/foundations call before the Event. Participation remains conditional on completing that review. If, following the medical review, we determine in our discretion that participation is not appropriate or safe for you, we will refund all amounts you have paid for the Event in full.

You must be at least 18 years of age to apply or participate. By applying, you represent that the information you provide in your application, intake questionnaire, and medical review is true, complete, and accurate, and that you will promptly notify us of any material change before the Event.

3. Pricing, Payment, and Refund Policy

A. Pricing and Payment

Event pricing, including any early bird or other discounted rates, is as displayed at the time of purchase. Discounts are available only during the period and to the individuals for whom they are offered, and may not be applied retroactively. All payments are processed through our third-party payment processor. By providing payment information, you authorize us to charge the payment method you provide for the full purchase price or for each scheduled installment.

B. Payment Plans

If you enroll using a payment plan, you agree to pay every installment on the schedule presented at checkout. Enrolling in a payment plan is a commitment to pay the full purchase price; it is not a month-to-month arrangement. If an installment fails, we will attempt to contact you and may retry the charge. If your account is not brought current within 10 days, we may suspend your enrollment. All installments must be paid in full by December 15, 2026, unless otherwise agreed in writing.

C. Our Arrival Satisfaction Guarantee

We created The ADVANCE to exceed your expectations, and we stand behind it. If you arrive at the Event and are not satisfied with the experience, you may request a full refund of the amount you paid for the Event, subject to the following conditions:

You must attend the Event in person and notify Melanie Winsor or a designated Theta Integrated team member of your refund request no later than the close of programming on the first day of the Event (January 8, 2027).

To protect the experience of the group, a Participant who requests a refund under this guarantee will conclude her participation and depart the Event, and her accommodations, meals, and programming will end at that time.

Approved refunds will be issued to the original payment method within 14 business days after the Event. If you are on a payment plan, you will be refunded all installments paid, and any remaining installments will be cancelled.

This guarantee covers amounts paid to the Company for the Event only. It does not cover travel, lodging outside of Event accommodations, or any other costs you incur to attend.

This guarantee does not apply if you do not attend the Event, or if you are removed from the Event under Section 6 (Participant Conduct).

D. Cancellations Before the Event

All payments for the Event are non-refundable if you cancel before the Event, including if you choose not to attend or do not attend. This applies to payments made in full and to payment plans; if you are on a payment plan, you remain responsible for all remaining installments.

Your registration may not be transferred to another person without our written approval, which may require the new participant to complete the application and medical review process.

E. Cancellation or Rescheduling by the Company

If we cancel the Event, you may choose to receive a full refund of the amounts paid for the Event or to transfer your registration to a future ADVANCE event. If we reschedule the Event, you may transfer to the new date or request a full refund. We are not responsible for travel or other expenses you incur, including non-refundable airfare, in connection with a cancelled or rescheduled Event. We strongly recommend purchasing travel insurance.

F. Chargebacks

If you have a concern about a charge, please contact us first at [email protected] so we can make it right. Initiating a chargeback or payment dispute for a payment that is not eligible for a refund under these Terms is a breach of these Terms, and we reserve the right to provide these Terms and your enrollment records to the payment processor.

4. Not Medical or Mental Health Treatment

The ADVANCE is an educational, experiential, and personal growth program. It is not medical care, psychotherapy, counseling, or a substitute for diagnosis or treatment by a licensed physician or mental health professional. While some members of our team may hold professional licenses, they are not acting as your healthcare provider in connection with the Event, and no provider–patient or therapist–client relationship is created by your participation. Astrology readings and similar offerings are provided for reflection and personal insight only.

You are responsible for your own physical and mental health. You agree to disclose fully and honestly any medical conditions, mental health history, medications, and other information requested during the medical review, and to continue following the advice of your own healthcare providers. Do not stop or change any medication without consulting your prescribing provider.

5. Voluntary Participation and Assumption of Risk

All activities at the Event, including breathwork, movement, sound, ceremony, group sharing, outdoor activities, and emotionally intensive practices, are voluntary. You may choose not to participate in any activity at any time. You understand that these activities may involve physical exertion and may bring up strong emotions or memories, and you knowingly and voluntarily assume the risks associated with participating.

In the event of a medical or mental health emergency, you authorize the Company and its team to seek emergency medical care on your behalf, and you agree to be responsible for any resulting costs. We may ask you to pause or discontinue participation in any activity, or in the Event, if we believe it is necessary for your safety or the safety of others.

6. Participant Conduct

The container is the heart of this work, and every Participant shares responsibility for it. You agree to treat other Participants, facilitators, staff, and the venue with respect; to follow the reasonable guidance of the facilitation team; to comply with venue rules and applicable law; and to refrain from harassment, discrimination, violence, the use of alcohol or illegal substances at the Event, and any behavior that disrupts the group or compromises anyone's safety.

We may remove any Participant from the Event, without refund, if we determine in our reasonable discretion that her conduct violates these Terms or threatens the safety, wellbeing, or experience of the group.

7. Confidentiality and Recording

What other Participants share at the Event belongs to them. You agree not to disclose the identity of other Participants or anything shared by them during the Event or in the private community, except as required by law. You may not photograph, record audio or video of, or livestream any portion of the Event or any other Participant without our and that person's express consent.

The Company may photograph or record portions of the Event, including the professional portrait session, for Participant use and, where you have provided separate written consent, for promotional purposes. Any use of your name, image, likeness, or testimonial for marketing is governed by our separate Testimonial Release Agreement, and we will not use them for marketing without that consent.

8. Accommodations and Private Community

Accommodations are assigned by the Company and may be shared unless a private room upgrade is purchased and available. You agree to comply with all rules of the venue and are responsible for any damage you cause to the property.

Access to the private online community is provided for the benefit of enrolled Participants, is personal to you, and may not be shared. We may modify or discontinue the community platform and may remove any member who violates these Terms or the community guidelines.

9. Intellectual Property

All content on the Site and provided through the Services, including the Theta Method, facilitator materials, workbooks, recordings, text, graphics, logos, and trademarks, is owned by or licensed to the Company and is protected by copyright, trademark, and other intellectual property laws. You receive a limited, personal, non-transferable license to use materials provided to you for your own personal, non-commercial use. You may not copy, reproduce, distribute, teach, sell, or create derivative works from any of our materials without our prior written permission.

10. Privacy

Your use of the Site and Services is also governed by our Privacy Policy, available at https://theta-integrated.com/privacy-policy. Health and personal information you provide in your application, intake questionnaire, or medical review is used to evaluate fit and safety, to prepare for and deliver the Event, and for no other purpose without your consent.

11. Third-Party Services and Links

The Site and Services may rely on or link to third-party providers, including payment processors, scheduling tools, community platforms, and venues. We are not responsible for the content, policies, or practices of third parties, and your use of third-party services is subject to their terms.

12. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, INCLUDING THE ARRIVAL SATISFACTION GUARANTEE, THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY PARTICULAR PERSONAL, EMOTIONAL, PHYSICAL, FINANCIAL, OR SPIRITUAL OUTCOME FROM YOUR PARTICIPATION. TESTIMONIALS REFLECT THE EXPERIENCES OF INDIVIDUAL PARTICIPANTS AND ARE NOT A PROMISE OF SIMILAR RESULTS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, FACILITATORS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY FOR THE SERVICE GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify and hold harmless the Company and its owners, officers, employees, facilitators, contractors, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your breach of these Terms, your conduct at the Event, your violation of any law, or your violation of the rights of any other person.

15. Governing Law

These Terms are governed by the laws of the State of [Utah], without regard to its conflict of law principles. Subject to Section 16, you consent to the exclusive jurisdiction of the state and federal courts located in [Utah County, Utah].

16. Arbitration

Please contact us first so we can try to resolve any concern informally. If a dispute cannot be resolved within 30 days of written notice, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in [Salt Lake City, Utah] or by video conference. Judgment on the award may be entered in any court of competent jurisdiction. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect its intellectual property.

BY AGREEING TO THESE TERMS, YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO HAVE ANY DISPUTE RESOLVED IN COURT, EXCEPT AS PROVIDED ABOVE.

17. Class Action Waiver

ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OF MORE THAN ONE PERSON.

18. Attorneys' Fees

In any arbitration or legal proceeding to enforce these Terms, the prevailing party will be entitled to recover its reasonable attorneys' fees and costs, to the extent permitted by applicable law and the applicable arbitration rules.

19. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, severe weather, fire, pandemic or public health orders, government action, venue closure, or travel disruptions. If such an event prevents the Event from taking place, Section 3.E will apply.

20. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy and any participant agreement, waiver, or release you sign, are the entire agreement between you and the Company regarding the Services. Our failure to enforce any provision is not a waiver of it.

21. Changes to These Terms

We may update these Terms from time to time by posting a revised version on the Site with a new "Last Revised" date. Changes will not apply retroactively to an Event registration already purchased unless you agree to them or the change is required by law.

A STANDARD OF CARE

This field is the wild west. It doesn't have to be.

We hear it on almost every consult call. Someone went somewhere, put themselves in the hands of a person who didn't know what they were doing, and came out saying I didn't feel safe. Sometimes worse.

That should not be the cost of admission for people trying to heal.

Facilitators trained in trauma-informed care rather than certified by a weekend. Preparation before, structured support after, and a real container the whole way through.

Our intention is to help make this a genuine standard of care — not because it's good marketing, but because people are getting hurt while the field figures itself out.
